1. Acceptance of Terms

By downloading, installing, or using the Ahem mobile application ("the App"), operated from Sweden, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Ahem. Please read them carefully, especially the sections regarding content disclaimers, assumption of risk, and limitation of liability.

By using this App, you acknowledge that you understand and accept its entertainment nature and the potential for content that may be offensive or uncomfortable.

2. Description of Service

Ahem is an entertainment application that analyzes your Android device's app usage statistics and generates humorous, AI-powered "roasts" based on those patterns. The service requires:

• Google account authentication
• Usage Access permission to read app usage statistics
• Internet connection to communicate with our servers

3. User Requirements

To use Ahem, you must:

• Be at least 13 years of age
• Have a valid Google account
• Own an Android device running Android 6.0 (Marshmallow) or later (API level 23+)
• Grant necessary permissions for the App to function
• Agree to our Privacy Policy

5. User Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or hack the App
• Share, resell, or redistribute roasts in commercial contexts without permission
• Abuse, harass, or harm others using content generated by the App
• Use automated tools (bots) to interact with the App
• Overload or attempt to disrupt our servers or infrastructure

6. Content and AI-Generated Roasts

6.1 Nature of Content

Roasts generated by Ahem are:

• Created by artificial intelligence (Google Gemini API)
• Intended for entertainment and humor purposes only
• Not professional advice, counseling, or commentary of any kind
• May contain humor that is critical, sarcastic, exaggerated, or offensive
• Not intended to be taken seriously or literally

Important Warning: By using this App, you acknowledge that the purpose of the service is to generate humorous "roasts" that may be critical or mocking in nature. If you are sensitive to criticism or humor about your device usage habits, this App may not be suitable for you.

6.2 No Warranty on Accuracy

While roasts are based on your actual usage data, the interpretations and commentary are AI-generated and may be inaccurate, exaggerated, or absurd. We make no claims about the truthfulness or accuracy of roast content. Roasts should not be interpreted as factual statements about you or your character.

6.3 User Responsibility

If you choose to share roasts on social media or with others, you do so at your own risk. We are not responsible for any consequences arising from sharing content generated by the App, including but not limited to social, professional, or personal repercussions.

6.4 Assumption of Risk

By using the App to generate roasts, you expressly acknowledge and agree that:

• You understand the App is designed to generate humorous, critical content about your usage habits
• You voluntarily choose to receive this content knowing it may be offensive, embarrassing, or uncomfortable
• You accept full responsibility for any emotional, psychological, or other personal impact from viewing roast content
• You will not hold us liable for hurt feelings, embarrassment, or emotional distress resulting from AI-generated roasts
• You use the App at your own risk and discretion

If you do not agree to these terms or are uncomfortable with potentially critical humor, do not use the roast generation feature.

7. In-App Purchases and Credits

7.1 Credit System

Ahem uses a credit system where each roast generation consumes one (1) credit. New users receive free credits upon account creation. Additional credits can be purchased through Google Play Billing.

7.2 Purchases

All in-app purchases are processed through Google Play's billing system. By making a purchase, you agree to Google Play's terms of service and payment policies.

• Credits are non-refundable once purchased (subject to Google Play's refund policy below)
• Credits do not expire and remain in your account indefinitely
• Credits are tied to your account and cannot be transferred to another user
• If you delete your account, all unused credits are permanently lost

7.3 Pricing

We reserve the right to modify pricing for credit packages at any time. Price changes will not affect credits already purchased. Current prices are displayed in the App and are in your local currency as determined by Google Play.

7.4 Refund Policy

Google Play Refund Policy: Accidental purchases may be eligible for refund within 48 hours through Google Play. To request a refund, contact Google Play support directly.

Our Policy: Once credits are used to generate roasts, they are considered consumed and are not refundable. Unused credits are non-refundable except as required by applicable consumer protection laws or Google Play's refund policy.

EU Consumers: Your statutory right of withdrawal under EU consumer protection laws does not apply to digital content (credits) once you begin using them to generate roasts, as this constitutes performance of the contract.

7.5 Payment Processing

We do not process payments directly or store your payment information. All transactions are handled securely by Google Play. For payment-related issues, contact Google Play support.

8. Intellectual Property and Content Rights

8.1 App Ownership

The Ahem application, including its design, code, branding, logos, and features, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer the App.

8.2 Your Content Rights

Roasts generated for you may be used and shared by you freely. You are welcome and encouraged to:

• Share roast screenshots on social media
• Share roasts with friends and family
• Use roasts for personal, non-commercial purposes

While attribution is not required, we appreciate when users credit Ahem when sharing content online.

8.3 Commercial Use

Commercial use, resale, or redistribution of roasts or App content requires prior written permission. Contact us at contact@ahem.fyi for licensing inquiries.

9. Disclaimer of Warranties

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Fitness for a particular purpose
• Accuracy or reliability of AI-generated content
• Uninterrupted or error-free operation
• Security of data transmission

EU/EEA Consumers: Nothing in these Terms affects your statutory rights as a consumer under applicable EU consumer protection laws. Where we cannot exclude warranties under applicable law, our liability is limited to the maximum extent permitted.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Emotional distress, hurt feelings, embarrassment, or psychological harm from AI-generated roast content
• Offense taken from humorous or critical content generated by the App
• Anxiety, stress, or mental discomfort related to viewing roasts
• Loss of data or privacy breaches caused by third parties
• Damage to reputation, relationships, or social standing from shared content
• Service interruptions, errors, or downtime
• Loss of credits due to technical issues or service failures
• Any other damages arising from the nature, tone, or content of AI-generated roasts

You expressly waive any claims for emotional distress, mental anguish, or similar damages arising from the intended functionality of the App (generating humorous roasts). By using the App, you accept these risks voluntarily.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

EU/EEA Consumers: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law. However, liability for emotional distress from entertainment content is limited to the maximum extent permitted under EU law.

11. Service Availability and Modifications

11.1 Service Availability

We strive to keep the App available at all times, but we do not guarantee uninterrupted service. The App may be unavailable due to:

• Scheduled maintenance
• Technical issues or server downtime
• Third-party service failures (Firebase, Gemini API, Google Play)
• Force majeure events beyond our control

11.2 Right to Modify or Discontinue

We reserve the right to modify, suspend, or discontinue the App or any features at any time with or without notice. We will make reasonable efforts to notify users of significant changes in advance.

If we discontinue the App permanently, we will provide at least 30 days' notice where reasonably possible.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ahem, its owners, operators, employees, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the App and roast generation services
• Your sharing of roast content on social media or with third parties
• Claims by third parties alleging emotional distress, defamation, or other harm from content you shared
• Your violation of these Terms or applicable laws
• Your violation of any third-party rights
• Any claim that you were harmed by AI-generated roast content you voluntarily requested

This indemnification obligation shall survive termination of these Terms and your use of the App.

13. Account Termination

13.1 Termination by Us

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent, abusive, or harmful behavior
• Attempts to circumvent payment systems or manipulate credits
• Any reason at our sole discretion, with or without cause

13.2 Termination by You

You may delete your account at any time by contacting us at contact@ahem.fyi or submitting an account deletion request via our Account Deletion Request Form. Upon account deletion:

• All unused credits are permanently forfeited (no refund)
• Your account data will be deleted within 30 days
• You may uninstall the App from your device

14. Third-Party Services

The App integrates with the following third-party services:

• Firebase (Authentication, Cloud Functions, Firestore, Crashlytics, Analytics)
• Google Sign-In (Account authentication)
• Google Gemini API (AI roast generation)
• Google Play Billing (In-app purchases and payments)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service failures, changes, or discontinuations. Links to third-party policies are provided in our Privacy Policy.

15. Updates and Changes to Terms

We may update the App and these Terms at any time. Changes will be effective upon posting the updated Terms with a new "Last Updated" date. We will notify users of material changes through:

• In-app notifications
• Email to your registered address
• Prominent notice on our website

Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and may delete your account.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Sweden.

16.2 EU Consumer Rights

If you are a consumer residing in the European Union, you benefit from mandatory consumer protection provisions under EU law. Nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

16.3 Online Dispute Resolution (EU)

EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes:

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely matches the intent of the original provision.
